1. Products

1.1 The products in our website can be supplied by us. For the orders outside of Istanbul there are some related delivery limitations on the website.

1.2 Guides for the official designing of the product and the information about it have binding qualities for Kaktus, and Kaktüs Florist ascribes importance to the content. However, in the case of any inconsistency about the supplies, Kaktus preserves the right to use an equivalent kind of the product, on the condition that Kaktus Florist shall use the visual and price equivalent of the product.

1.3 Some products, which are on sale in the website, can be poisonous in case of oral usage, or they may lead to allergies due to pollens. Whatever the kind of the product is, it is strongly recommended that no products should be used orally and smelled by those who are allergic.

2. Prices & Payment

2.1 Prices of the products are labeled in the form of Turkish Liras in Turkish version of the page, whereas they are labeled in the form of American dollars in the English version. When paid in American dollars, the credit card transactions are carried out in Turkish Lira, based on the exchange rate updated by us.

2.2 The paid total may vary in the customers credit card when compared to the product price in American dollar-based credit cards since the transaction is made in TRL and the credit card issuer specifies the total in USD from TRL in credit card statements. In order for the above-mentioned case to be in favor of the card owner, a currency that is lower than the rate of Central Bank of the Republic of Turkey is taken into account when calculating the amount that is transferred to POS system. If the discrepancy is usually in cents not to be more than 2% due to currency fluctiations, the difference can be subject to be returned if the total exceeds a tolarable value and is proved.

2.3 Whatever the time of delivery is, the price for the product at the time of on-line ordering in the website is valid.

2.4 All taxes are included in the prices. For the orders, a legal receipt is prepared by Kaktus Florist. The sender or the recipient, declaring the reference number, can receive the related receipt from the store.

2.5 Prices that are stated in the web pages are valid for the delivery within Istanbul. There is the cost of delivery for the ones outside of Istanbul, and from which cities we accept order is stated in the section of Orders Outside of Istanbul.

2.6 Prices and the cost of delivery (if there is) that can be found in the payment section constitute the basis for the amount of the payment.

2.7 In the case of the denial of the order by the sender because of the attempts of fradulent credit card use, the payment will be returned after some examination on the incident. In this case the value of the product is collected from the receiver through agreement or via legal commercial procedures.

2.8 In case the payment is returned, equivalent value of the amount in Turkish Lira, that is transferred to the bank will be considered as the basis. Responsibilities stemming from the differences due to the currency fluctiations of the issuer of the credit card, either for or against, belong to the customer.

3. Orders & Delivery

3.1 Ordering links related to the products lead the visitor to the ordering form. There are explanations about the usage of form and about the order both in ordering form and payment form that comes after the sending of the first one.

3.2 In the case that the information required both in ordering form and payment form is complete and true and that the payment is made reliably, Kaktus Florist is responsible to process the order. In the case of incomplete and incorrect information, if there is an opportunity to contact with the one who orders through the information he/she provides, we shall contact with him/her.

3.3 When there is a problem related to address and delivery Kaktus firstly contact with the recepient, if we are not able to reach the receiver, then contact with the sender.

3.4 The sender is responsible for the delays in the case that s/he gives incorrect information.

3.5 The sender must be above eighteen (18) years old. We accept the very fact that ordering attempt by people who are below eighteen, their use of payment means of their parents or third parties are within the responsibility of their parents.

3.6 After the order form and the payment form has been sent, if it is paid successfully the visitor is informed about it, and an automatic e-mail is sent to the e-mail address s/he specified. This e-mail should be returned as it is without deleting the Reply function of the e-mail software. It is not necessary to add a comment into this e-mail. The comment should not be a further demand that inquires a change in the price of the product. We take into consideration the demands that are related to corrections in the ordering information.

3.7 If the recipient is not in the due place, the right of Kaktüs Florist to decide whether to make delivery to the people that are close to the receiver or to delay is legally guaranteed.

3.8 The time of the ordering should be at least 24 hours earlier than the delivery time. We make deliveries seven days of the week from 9.00 to 20.00.

3.9 When there is no way of making the delivery directly to the receiver in such places where the delivery is made via a third party (hospitals, offices, airports, hotels, etc…) the product is delivered to the authorized person, and the signature of relevant third party is sufficient to prove that the delivery is made by us.

4. Cancellation & Refund

4.1 Orders can be canceled in 24 hours or more time to the delivery.

4.2 In order to cancel the order it is sufficient to contact us at siparis@kaktuscicek.com or using the Customer Service Form, together with declaring the ordering number and then receiving a confirmation notice.

4.3 For the return of the paid amount, the condition stated in article 2.8 is valid.

4.4 Products could not be returned, canceled or changed after the delivery. Kaktus Florist may compensate an order in case of agreement upon the delivered product is incorrect or not in proper state during the delivery. All floral products may not be resistant to environmental conditions if not held in proper conditions.

4.5 Payment for orders those are not accepted by the recipient are not subject to be returned. It is the senders risk that the acceptibility of the product by the recipient.
